    Lightbulb "Money Back Guarantee"

    A COMMENT FOR EVERYONE ELSE FIRST: "While Tynon is still in Beta, it is "unfair" to have good people paying good money for Gems, which the defective software will rob them of what they have accomplished later on, in so many different ways." These good-hearted people who spend hundreds of dollars to enjoy the game... (With all that is within good Legal Reasoning)... "That these people deserve to have their money refunded while the Beta Phase of Tynon development is effectively robbing them of what they paid for." (Provided, that they have a way to prove it.) If Tynon keeps "system logs", and statistics of their purchases and loses in their database, this would be one way to prove it.

    In closing, "It is common commercial industry practice to give people their money back if the product is "defective", or with some companies, "If they are unhappy with the product in any way."."

    So what has prompted this commentary?

    • On Nov. 3, 2013 I lost almost "100,000", (91,241 to be exact), in the Power Rating at the top left corner of your window.

    • And on Nov. 4, 2013 I lost "22 Stars" for the "net gain" of "1".

    In this situation I believe that anyone can see that the game is "defective", and that their customers "are unhappy for perfectly legitimate reasons". Therefore we should be getting our money back if Tynon cannot make right to us what we had legitimately accomplished, and had by no fault of our own, had our accomplishments robbed from us.

    Lastly, this "money back guarantee" should be more than enough to "motivate the corporation" (ucool) to a quicker improvement of their software, and servers. (After all, it is only $4.75 for 50 Gems, is that asking too much for a refund? Therefore, $9.50 would essentially refund me 20 Stars. The problem seems to be, that after each failure, it does not raise the success percentages enough. Therefore, this seems to eliminate a way to succeed, and to enjoy the game.)

    PS: "It is not ucool to cheat your customers."

    You're playing BETA, which is filled with bugs in which players are suppose to figure out and report to Tynon.

    Beta isn't a stable version of the game, so why are you spending money on the testing platform and think you have the right to have a refund when something goes wrong?

    Server 30 isn't the beta (the server listed in the sig of the OP). And purchasing gems isn't available on the beta anyway anymore. It was originally for testing purposes, and then the purchases were transferred to the live characters on regular servers, as I understand it. I think perhaps the intended message of the OPs post was to say that the live servers are as buggy as one would expect from a beta version and therefore a refund would be in order if Tynon instituted a money back guarantee.

    More understandable, yet still no good reasons for a refund as OP stated.

    Losing 100k power can be caused by any number of reasons, changing of formation/runes.

    Losing 22 stars is based totally on chance when you decide to upgrade and isn't reason for a refund.

    Ditto.

    Losing power has so many factors tied into it. You might just need to refresh.

    Losing stars is a part of the system. There's a tooltip if you hover your mouse over the question mark in the same tab that you do Starring on.

Payment of Fees You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. uCool may revise the pricing for the goods and services offered through the Service at any time. YOU ACKNOWLEDGE THAT UCOOL IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ENHANCEMENTS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

    3. UPDATES TO THE SERVICE You understand that the Service is an evolving one. uCool may require that you accept updates to the Service and to the Tynon Service and Game. You acknowledge and agree that uCool may update the Tynon Service and Game, with or without notifying you. You may need to update third party software from time to time in order to use the Service and play Tynon.
    This ToS was agreed to by all of us when we created our accounts. Whether y'all think it's fair or not isn't revelant, we all have to abide by it.

    The act of clicking I agree to ToS does not qualify as a legally binding contract, or even an electronic signature and would not have much legal standing if Tynon was found to knowingly put out a buggy game that deprived people of a service they payed for.

    You don't own your account, that remains the property of uCool. Before the tirade of protests this is standard across all software, including your operating system.

    You can play on your account, power it up and exchange cash for in game currency (gems). What Tynon offer is a service and most games do have bugs in them. You don't pay a subscription fee, you pay for gems. The service is free and you can't claim money back on something you don't offically own or pay for.

    But most games do not have to be patch to add content because the original release did not have enough of it for the users to be able to play at the higher levels, or at least the game limits are documented in the game documentation so you know what you are getting before you spend money. Tynon does not have this because it has no documentation.
