    To me it is clear. You purchase the Gems and they were delivered. Attempting to get your money back because of non delivery is fraud.

    Ummm NO. I disagree. Someone threatening charge back on the forum is not a violation of anything except and it is a free speech. It is like saying, I am going to one day do durgs. Then cops show up at your door and arrest you for saying something that did not happen yet.

    As I said, the forum rules state (emphasis added)

    No extreme violence or illegal activity
    Discussion of extreme, graphic or shocking violence or any illegal activity or drug use is not allowed and strictly enforced.

    This is not a public forum. It is a private forum that has stated rules. The owner of the forum has a right to make the rules and enforce them. If you do not like the rules then get out. If you violate them then you will be kicked out. It is a simple as that.

    If you ask for your money back to tynon the forums is the right place for that but not agasint the credit card companies as dawnseeker pointed out that is fraud

    We allow conversation on the Tynon game, and occasional off-topic conversations. We allow posts that are critical and/or negative. We want players to feel free to express themselves, as long as they do so responsibly while following the forum guidelines.

    That said, there is no right to free speech on this forum. It is a private forum, run by a private company for the use of our players. Player use is conditional and may be revoked at any time, for any reason. If anyone doesn't follow the rules we have set up, they will have their posting privileges removed, and the courts will not intervene.

    This is not a private game. This is a public game. This game was intended for anyone to play and thus open's door to interpretation of this forum abiding by the TOA of the game maker.

    Stating things on the forum unless it is acted upon should not be executed by the game maker. The thread can be closed, it can be deleted, etc, but suspension seems excessive.

    Also I am not condoning this behavior, I am just trying to be fair to all parties.

    The only thing the person did wrong was express his views and state things that may give others ideas of doing the same thing. There is a lot of propaganda out there that does the same thing against presidents, and high officials, we do not incarcerate them for a day or two in a jail as a result of it unless it is Russia with Putin as the two headed monkey running it, or the Taliban.

    We are neither and I hope Tynon is not as well.

    Wrong, Tynon is private property and its owners reserve the right to set rules and kick people out at any time.

    Then, they should issue a refund. The world does not work the way you just described. There are laws in place to protect the consumer.

    Unless he violated the terms of the agreement of the game, the owners have no right to "kick him out".

    I think I will "kick you out of your house that you are renting" because your kid said he is going to do a charge back on the rent. ROFL

    You really won't accept your're wrong will ya?

    OK put it this way. When you create an account with Tynon/uCool you agree to their Terms of Service (TOS) which states that Tynon/uCool reserve the right to close any account. If they decide that you have violated their TOS, they are within their rights to do this and since you, the person who got their account banned is in the wrong, they are under no obligation to refund you. Try and argue whatever legal angle you want, you make it official, you'll lose and that's if any attorney is dumb enough to take it on.

    Now before we all forget what this thread is really about lets return to the server merges. Hope it's going great for you guys.
