its definitely exploiting, you're going around how the game was meant to be played. Whether it be sailing, saints, white tier maria's and/or all the known exploits, if it goes around the intended mechanics are as such.
Things like cw fights or setting palace or anything that you can do without having to go around the system isn't a exploit nor against the ToS, if anything they can easily be considered in poor taste or bad etiquette; but not an exploit.

About the Lab, Scarlet you are right. The match fixing is as far as we know not against the ToS but it is a kind of exploit. Exploits aren't necessarily illegal.
